Terms of Service

By accessing or using KlausPicks (the "Service", "Platform", "Website") at klauspicks.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please stop using the Service immediately.

These Terms constitute a legally binding agreement between you and the operator of KlausPicks (see Section 2). They apply to all visitors, registered users, event organisers, participants, and wishlist viewers.

Use of the Service also implies acceptance of our Privacy Policy and Cookies Policy, which are incorporated herein by reference.

KlausPicks provides a free online platform that enables users to:

• Organise Secret Santa gift exchanges — create events, invite participants via email, perform random gift assignments, and send reveal notifications.
• Create and share wishlists — curate lists of desired items and share them with friends and family via a unique link.
• Browse curated gift ideas with affiliate product links across various categories and price ranges.

The Service is provided free of charge. We may generate revenue through affiliate commissions when users click product links and make purchases (see Section 8).

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and we shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

You must meet the following minimum age requirements to use the Service:

• 16 years or older if you are located in the European Union or European Economic Area (as required by GDPR Article 8).
• 13 years or older in all other jurisdictions.

By using the Service, you confirm that you meet the applicable age requirement. If you are a minor under the applicable age limit, you must have verifiable parental or guardian consent before using the Service, and a parent or guardian must review and agree to these Terms on your behalf.

We do not knowingly collect personal data from children below the applicable minimum age. If we become aware that a minor below the minimum age has provided personal data without appropriate consent, we will delete that information promptly.

Creating an account is optional — you can view shared wishlists and claim items as a guest. However, creating events and managing your own wishlists requires registration.

When you create an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and promptly notify us of any unauthorised access.
• Accept responsibility for all activities that occur under your account.
• Not share your account credentials with third parties.

You may delete your account at any time by contacting us at privacy@klauspicks.com. Account deletion will remove your personal profile data. Event and wishlist data may be retained for the period set out in our Privacy Policy to honour participants' legitimate interests.

We reserve the right to terminate or suspend accounts that violate these Terms, with or without prior notice.

When you create a Secret Santa event on KlausPicks, you act as the event organiser. By doing so, you represent, warrant, and agree that:

• You have obtained the freely given, specific, informed, and unambiguous consent of every participant whose email address you enter into the platform, or you are otherwise acting within a legitimate basis (e.g., legitimate interest within a clear personal relationship such as family or close friends) to share their email address with us for the sole purpose of the gift exchange.
• You have informed participants that they will receive a Secret Santa assignment email from KlausPicks on your behalf.
• All participant email addresses provided are real, belong to real people, and are used with the knowledge of the address holder.
• You will not use the platform to send unsolicited or spam email to any person.

You, as the organiser, are solely responsible for the conduct of the event, including any disputes between participants regarding gifts, amounts, or exclusions. KlausPicks facilitates the draw and notifications only and is not a party to the gifting arrangement.

Organiser data and participant data associated with an event may be retained for up to three (3) years from the date of last activity, after which it will be permanently deleted. Organisers may request earlier deletion by contacting us.

The wishlist feature allows you to create a list of items and share it via a unique link. You agree that:

• You will not add links or descriptions that contain illegal, harmful, defamatory, sexually explicit, or otherwise objectionable content.
• Product links you add may include affiliate links from third-party retailers. We are not responsible for product availability, pricing, quality, or any transaction between you and a retailer.
• Wishlists set to "shared" or "public" privacy are accessible to anyone with the link. Set your privacy preference accordingly.
• Gift claiming by guests (without an account) is anonymous to the wishlist owner. Claim data may be stored as an anonymous identifier. Claimants bear their own responsibility for following through on a claimed gift.

We are not responsible for duplicate gifts, missed gifts, or any dispute arising from wishlist interactions.

KlausPicks participates in affiliate marketing programmes. This means that certain product links on our platform — including links on gift ideas pages, wishlist items, and Secret Santa reveal pages — may be affiliate links. When you click such a link and make a purchase, we may receive a commission at no additional cost to you.

These programmes may include, but are not limited to:

• Amazon Associates / Amazon affiliate programmes (various regions)
• Profitshare (Romania and CEE region)
• 2Performant network
• Other affiliate networks and direct merchant programmes

Affiliate relationships do not influence the editorial selection or ranking of gift ideas on the platform. We aim to recommend relevant and useful products regardless of affiliate status.

We are not a party to any transaction between you and a retailer. All purchases are subject to the retailer's own terms and policies. We make no representations or warranties about products, their quality, fitness for purpose, delivery, or return policies.

KlausPicks offers an optional "Buy Me a Coffee" button as a way to support the platform. Donations are entirely voluntary and processed through Buy Me a Coffee (buymeacoffee.com), a third-party payment platform.

We do not directly collect, process, or store any payment card information. All payment processing is handled exclusively by Buy Me a Coffee in accordance with their own Terms of Service and Privacy Policy.

Donations are non-refundable and do not confer any preferential service, premium features, or commercial relationship with KlausPicks beyond a gesture of goodwill.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Input personal data (including email addresses) of third parties without a lawful basis or without their knowledge and consent.
• Attempt to circumvent, reverse-engineer, or disrupt the platform, including automated scraping, crawling, or probing for vulnerabilities without prior written authorisation.
• Transmit any viruses, malware, spam, or other harmful code via the Service.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the Service to collect or harvest personal data of other users without their consent.
• Attempt to access accounts, data, or systems belonging to other users without authorisation.
• Use the platform to send bulk unsolicited communications ("spam") to participants of an event.

Violation of these prohibitions may result in immediate account termination, reporting to competent authorities, and/or legal action.

All content, design, code, branding, logos, and other materials on KlausPicks (the "KlausPicks IP") are the property of ROȘATĂ PATRICIU PFA or are used under licence. You may not copy, reproduce, modify, distribute, or create derivative works from any KlausPicks IP without prior written consent.

By submitting content to the platform (e.g., wishlist item names, descriptions, event names), you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to use, display, and store that content solely for the purpose of providing the Service to you.

You retain all ownership rights in the content you submit. You represent that you have all necessary rights to grant the above licence.

To the maximum extent permitted by applicable law, KlausPicks (and its operator, employees, agents, and licensors) shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or other intangible losses.
• Damages arising from your inability to access or use the Service, or from any content obtained through the Service.
• Damages arising from unauthorised access to, or alteration of, your transmissions or data.
• Failure of any gift exchange event, including missed assignments, incorrect draws, email delivery failures, or disputes between participants.
• Loss or damage arising from your reliance on affiliate product links or third-party services accessible through the platform.

In any case, our total aggregate liability to you for any claims arising out of or related to the Service shall not exceed EUR 50 (fifty euro) or the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted, error-free operation.

We do not warrant that:

• The Service will be available at all times or free from errors or bugs.
• Results obtained through the Service will be accurate or reliable.
• Any errors in the Service will be corrected.
• Emails sent on behalf of event organisers (draw reveals, invitations) will be successfully delivered to all recipients.

You use the Service entirely at your own risk.

You agree to indemnify, defend, and hold harmless KlausPicks, its operator (ROȘATĂ PATRICIU PFA), and its agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service or violation of these Terms.
• Your submission of personal data of third parties without a lawful basis, including participant email addresses added to events without proper consent.
• Any content you submit, post, or transmit through the Service.
• Your infringement of any third-party intellectual property or privacy rights.

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions, and subject to the applicable regulations of the European Union.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Bucharest, Romania.

If you are a consumer resident in the EU, you may also benefit from mandatory consumer protection provisions of the law of the country in which you are habitually resident, and may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the Service after any changes constitutes your acceptance of the revised Terms.

If we make changes that materially affect your rights, we will make reasonable efforts to notify registered users via email or via an in-app notice.
